Court Denies Reconsideration Again for Comsat Quarry

For the second time, the Alaska Superior Court denied the State’s request for reconsideration in the Comsat Quarry case.
The Court initially handed down a judgement in April in favor of the Comsat Area Lakes and Land Alliance, or CALLA. The narrow argument focused on the constitutionality of materials sales at the Comsat Quarry site.
CALLA’s attorneys argued that the public should have been notified of the materials sales because they are disposals. The State of Alaska argued they were not.
According to CALLA attorney Geoff Parker, the Court’s most recent order issued last week was one-sentence long. It denied the State’s request for reconsideration in the decision. The Alaska Department of Natural Resources, or DNR, must now give notice when materials are sold from the Comsat Quarry site.
There is no timeline for the Court to enter a final judgment, but once that is complete, the State can appeal if they choose. The Quarry remains under Alaska DNR management, but it is still unclear what the site’s future might be.
