Terms of Use for KTNA services

Please read these terms carefully.

Welcome to KTNA, Talkeetna Community Radio Inc (“KTNA,” “we,” “our,” or “us”). These Terms of Use govern your access to and use of KTNA Services, as defined below.

By using, accessing, listening to, submitting information to, donating through, sponsoring, volunteering with, participating in, communicating with, or otherwise interacting with KTNA Services, you agree to these Terms of Use. If you do not agree, please do not use, access, participate in, or interact with KTNA Services.

1. Agreement to Terms and Scope of Services

These Terms of Use apply to your access to and use of KTNA’s website, online content, live and archived audio streams, radio programming, community announcement services, calendar listings, classified submissions, donation and membership tools, underwriting and sponsorship services, public service announcement services, forms, email communications, digital platforms, social media pages, events, volunteer services, and any other KTNA-operated or KTNA-provided services, whether online, over the air, by phone, by email, in person, or through a third-party platform where KTNA content or services are made available. These are collectively referred to in these Terms as the “KTNA Services.”

By accessing, listening to, submitting information to, donating through, sponsoring, volunteering with, participating in, communicating with, or otherwise using any KTNA Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and KTNA’s Privacy Policy.

If you do not agree to these Terms of Use, you should not access, use, submit content to, participate in, or otherwise interact with KTNA Services.

KTNA reserves all rights not expressly granted in these Terms of Use. Nothing in these Terms transfers ownership of any KTNA content, trademarks, logos, audio, text, images, graphics, website design, programming, broadcasts, recordings, station materials, or other materials to you. KTNA may modify, suspend, restrict, or discontinue any part of KTNA Services at any time, with or without notice, to the fullest extent permitted by law.

2. About KTNA

KTNA is a community radio station serving Talkeetna and the Upper Susitna Valley. KTNA Services may provide access to news, public affairs programming, community announcements, audio content, station information, donation opportunities, volunteer information, underwriting information, events, and other community resources.

3. Use of KTNA Services

You may use KTNA Services for lawful, personal, informational, educational, and community-related purposes. You agree not to use KTNA Services in a way that:

  • Violates any applicable law or regulation;
  • Interferes with the operation, security, availability, or integrity of KTNA Services;
  • Attempts to gain unauthorized access to KTNA systems, accounts, data, facilities, equipment, or services;
  • Submits false, misleading, abusive, defamatory, obscene, threatening, discriminatory, harassing, or unlawful material;
  • Infringes the rights of KTNA or any third party;
  • Uses automated tools to scrape, copy, overload, or disrupt KTNA’s website or digital services without permission;
  • Disrupts KTNA events, volunteer activities, broadcasts, communications, staff, volunteers, or community services.

KTNA may restrict or terminate access to KTNA Services at any time if we believe these Terms have been violated.

4. KTNA Content

KTNA content is provided for general informational, educational, journalistic, cultural, and community purposes. While KTNA works to provide accurate and timely information, we do not guarantee that all information will always be complete, current, or error-free.

News stories, announcements, event listings, weather-related information, emergency information, public service announcements, broadcast content, online content, and other time-sensitive information may change. Users should verify important information with the original source when necessary.

KTNA Services and KTNA content are provided for general informational, journalistic, educational, cultural, and community purposes only. KTNA content is not intended to provide legal, medical, financial, emergency, safety, or other professional advice.

You should not rely solely on KTNA Services for emergency alerts, weather warnings, road conditions, evacuation information, medical decisions, legal decisions, financial decisions, or other important matters. In an emergency, contact 911, local emergency services, public safety officials, or the appropriate government agency.

6. Intellectual Property

Unless otherwise stated, KTNA content, including text, images, audio, graphics, logos, design elements, broadcasts, recordings, programming, and other materials, is owned by KTNA, licensed to KTNA, or used with permission.

You may view, listen to, share, and link to KTNA content for personal, educational, nonprofit, or community purposes, provided that you do not alter the content in a misleading way and you provide appropriate credit to KTNA.

You may not reproduce, republish, sell, commercially exploit, rebroadcast, redistribute, or use substantial portions of KTNA content without prior written permission, except where permitted by law.

KTNA respects the intellectual property rights of others and expects users of KTNA Services to do the same. If you believe that material available through KTNA Services infringes your copyright, you may submit a written notice under the Digital Millennium Copyright Act (“DMCA”) requesting that the material be removed or access to it be disabled.

To submit a DMCA notice, please provide the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material claimed to be infringing and information reasonably sufficient to allow KTNA to locate the material;
  • Your name, mailing address, telephone number, and email address;
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, the owner’s agent, or the law;
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Upon receiving a valid DMCA notice, KTNA may remove or disable access to the allegedly infringing material and may notify the person or organization that provided the material.

8. DMCA Counter-Notices

If you believe that material you submitted to KTNA was removed or disabled by mistake or misidentification, you may submit a written counter-notice. The counter-notice must include:

  • Your physical or electronic signature;
  • Identification of the material that was removed or disabled and the location where it appeared before removal;
  • A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  • Your name, mailing address, telephone number, and email address;
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or if your address is outside the United States, the federal district court for the District of Alaska;
  • A statement that you will accept service of process from the person who submitted the original DMCA notice or that person’s agent.

If KTNA receives a valid counter-notice, we may restore the removed material unless the original complainant files a court action seeking to prevent restoration within the time period allowed by the DMCA.

9. Repeat Infringers

KTNA may, in appropriate circumstances, remove submitted content and restrict or terminate access to KTNA Services for users who repeatedly infringe copyrights or submit infringing material.

10. Audio Streams, Broadcasts, and Programs

KTNA may provide live radio broadcasts, live audio streams, archived audio, podcasts, interviews, station programming, public affairs programs, music programs, emergency information, and other audio content. Availability of audio or broadcast content may change without notice due to technical issues, licensing restrictions, programming changes, emergency needs, staffing, or station decisions.

You may not record, rebroadcast, redistribute, sell, commercially use, or otherwise exploit KTNA audio, broadcast, or program content without permission, except where allowed by applicable law.

11. User Submissions

KTNA Services may allow users to submit community announcements, calendar events, classified items, public service announcements, Denali Echoes items, comments, messages, volunteer forms, donation forms, underwriting inquiries, sponsorship materials, photos, audio, documents, or other materials.

By submitting content or information to KTNA, you confirm that:

  • The information you provide is accurate to the best of your knowledge;
  • You have the right to submit the content;
  • The content does not violate the rights of another person or organization;
  • The content does not contain unlawful, defamatory, threatening, obscene, discriminatory, harassing, misleading, or otherwise inappropriate material.

By submitting content, you give KTNA permission to review, edit, publish, decline, remove, broadcast, stream, archive, reproduce, display, distribute, or otherwise use the submission in connection with KTNA Services, including KTNA’s website, radio programming, social media, community calendar, public service announcements, and related services.

KTNA is not required to publish, broadcast, stream, or otherwise use any submission.

12. License to User Submissions

By submitting content, information, audio, photos, images, text, event listings, announcements, classified items, public service announcements, underwriting materials, sponsorship materials, story ideas, comments, messages, or other materials to KTNA, you grant KTNA a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to review, edit, publish, decline, remove, reproduce, broadcast, stream, archive, display, distribute, adapt, excerpt, and otherwise use the submission in connection with KTNA Services and KTNA’s mission.

You understand that KTNA may edit submissions for length, clarity, style, accuracy, scheduling, technical quality, legal compliance, and station policy. KTNA is not required to return submitted materials, compensate you for submissions, or publish, broadcast, stream, or otherwise use any submission.

13. Community Announcements, Classifieds, and Calendar Listings

KTNA may accept community announcements, classified listings, event notices, Denali Echoes submissions, calendar items, and similar public information. Submission does not guarantee publication, broadcast, streaming, posting, or distribution.

KTNA may edit submissions for length, clarity, formatting, accuracy, scheduling, or compliance with station policies. KTNA may decline or remove submissions for any reason, including submissions that are incomplete, inappropriate, commercial in nature where not permitted, misleading, discriminatory, unlawful, or inconsistent with KTNA’s mission or policies.

14. Editorial Discretion

KTNA retains full editorial, programming, scheduling, and operational discretion over KTNA Services, including decisions about what content to publish, broadcast, stream, edit, decline, remove, archive, or update.

Submission of content, payment for underwriting or sponsorship, membership, donation, volunteer participation, or communication with KTNA does not create any right to publication, broadcast, airtime, placement, continued access, or continued participation.

15. Regulatory Compliance

KTNA operates in a regulated broadcasting environment. KTNA may modify, reject, suspend, remove, or discontinue any content, announcement, underwriting message, sponsorship material, advertisement, public service announcement, broadcast, stream, or other service when KTNA believes it is necessary to comply with FCC rules, copyright law, music licensing requirements, nonprofit broadcasting standards, station policies, or other applicable legal or regulatory requirements.

16. Donations and Memberships

KTNA may provide donation, membership, and sustaining support options online, by mail, by phone, in person, at events, or through third-party platforms. Donations are subject to the terms of any payment processor, donation platform, or other third-party service used to process the transaction.

Unless otherwise stated, donations are voluntary and may not be refundable. If you believe a donation was made in error, please contact KTNA as soon as possible.

KTNA does not store full payment card information on its website unless expressly stated. Payment information may be collected and processed by third-party payment providers according to their own terms and privacy policies.

17. Underwriting, Sponsorship, and Advertising

KTNA may provide information about underwriting, sponsorship, web advertising, enhanced public service announcements, and related business or nonprofit support opportunities.

Submission of an underwriting, sponsorship, advertising, or enhanced PSA request does not guarantee acceptance, publication, broadcast, streaming, posting, or placement. KTNA may review, edit, decline, schedule, remove, or discontinue underwriting, sponsorship, advertising, or enhanced PSA content in accordance with station policies, FCC rules, applicable law, and KTNA’s editorial and community standards.

Rates, availability, placement, scheduling, and terms may change without notice unless otherwise agreed in writing.

18. Events, Volunteers, and Participation

KTNA may host, support, promote, or participate in events, volunteer activities, trainings, community projects, station activities, and other in-person or remote opportunities.

Participation in KTNA events, volunteer activities, or station-related activities may be subject to additional rules, requirements, safety procedures, waivers, training, scheduling, or approval by KTNA. KTNA may deny, limit, suspend, or end participation in any event, volunteer activity, or station-related activity at any time for safety, operational, legal, policy, or community-related reasons.

KTNA Services may link to, use, or embed third-party websites, services, tools, media players, forms, maps, videos, social media posts, donation platforms, payment processors, analytics tools, event tools, audio services, or other outside resources.

KTNA does not control and is not responsible for third-party websites or services. Your use of third-party services is governed by the terms and privacy policies of those third parties.

Links to third-party websites or services do not necessarily imply endorsement by KTNA.

20. Privacy

Your use of KTNA Services is also governed by KTNA’s Privacy Policy. Please review the Privacy Policy to understand how information may be collected, used, and shared when you use or interact with KTNA Services.

21. No Warranty

KTNA Services and KTNA content are provided “as is” and “as available.” KTNA makes no warranties, express or implied, regarding KTNA Services, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, uninterrupted operation, or suitability for any particular use.

KTNA does not guarantee that KTNA Services will be free from errors, viruses, technical problems, security issues, broadcast interruptions, streaming interruptions, scheduling changes, service interruptions, or unavailable content.

22. Limitation of Liability

To the fullest extent permitted by law, KTNA, its directors, officers, employees, volunteers, contractors, contributors, partners, and affiliates will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your access to, use of, participation in, reliance on, or inability to use any KTNA Services.

This includes, but is not limited to, damages related to website errors, interruptions, lost data, unauthorized access, third-party services, inaccurate information, broadcast or streaming interruptions, programming changes, community announcements, event listings, user submissions, donations, memberships, underwriting, sponsorship, volunteer activities, events, in-person interactions, emergency information, safety information, regulatory compliance decisions, editorial decisions, or reliance on KTNA content or services.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

23. Events Outside KTNA’s Control

KTNA will not be responsible or liable for any delay, interruption, failure, loss, or damage caused by events outside KTNA’s reasonable control, including natural disasters, severe weather, fires, floods, earthquakes, power outages, internet or telecommunications failures, equipment failures, transmitter failures, tower issues, cyberattacks, labor disruptions, public emergencies, government actions, acts of war, terrorism, civil unrest, pandemics, supply-chain disruptions, third-party service failures, or other events beyond KTNA’s reasonable control.

24. Indemnification

You agree to indemnify and hold harmless KTNA, its directors, officers, employees, volunteers, contractors, contributors, partners, and affiliates from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or related to:

  • Your access to, use of, participation in, or interaction with any KTNA Services;
  • Your violation of these Terms;
  • Your submission of content, announcements, calendar listings, classified items, underwriting materials, sponsorship materials, public service announcements, messages, forms, or other information to KTNA;
  • Your participation in KTNA events, volunteer activities, donation programs, membership programs, underwriting, sponsorship, or other station-related activities;
  • Your violation of any law, regulation, contract, intellectual property right, privacy right, publicity right, or other right of any person or organization.

25. Dispute Resolution and Arbitration

Please read this section carefully. It affects how disputes may be resolved.

If a dispute, claim, or controversy arises out of or relates to your access to, use of, participation in, reliance on, or interaction with any KTNA Services, these Terms of Use, KTNA’s Privacy Policy, KTNA content, KTNA communications, donations, memberships, underwriting, sponsorship, volunteer activities, community submissions, events, broadcasts, audio streams, online services, or any other relationship or interaction with KTNA, you and KTNA agree to first attempt to resolve the matter informally and in good faith.

Before filing any formal claim, the party raising the dispute must provide written notice describing the issue and allow a reasonable opportunity for informal resolution.

If the dispute cannot be resolved informally, you and KTNA agree that the dispute will be resolved by binding arbitration rather than in court, except where prohibited by law or where the claim qualifies for small claims court.

Arbitration will be conducted by a neutral arbitrator under applicable arbitration rules. The arbitrator will have authority to resolve the dispute and award relief allowed by law. Judgment on the arbitration award may be entered in a court of competent jurisdiction.

You and KTNA agree that any dispute will be brought only on an individual basis. You and KTNA waive the right to bring or participate in any class action, collective action, representative action, or class-wide arbitration to the fullest extent permitted by law.

Nothing in this section prevents either party from seeking temporary or emergency injunctive relief in court where necessary to protect intellectual property, privacy, security, confidential information, safety, property, or other rights.

If any part of this arbitration section is found unenforceable, the remaining portions will continue to apply to the fullest extent permitted by law.

26. Governing Law

These Terms of Use are governed by the laws of the State of Alaska, without regard to conflict-of-law principles, except where federal law applies.

Subject to the arbitration section above, any court proceeding related to these Terms, KTNA Services, or any dispute involving KTNA must be brought in a court of competent jurisdiction in Alaska.

27. Severability and No Waiver

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect to the fullest extent permitted by law.

KTNA’s failure to enforce any provision of these Terms does not waive KTNA’s right to enforce that provision or any other provision later.

28. Entire Agreement

These Terms, together with KTNA’s Privacy Policy and any additional written agreements or policies expressly referenced by KTNA, constitute the entire agreement between you and KTNA regarding KTNA Services and supersede any prior or contemporaneous understandings, communications, or agreements regarding the same subject matter.

29. Changes to These Terms

KTNA may update these Terms of Use from time to time. When changes are made, the updated version will be posted on KTNA’s website with a revised effective date.

Your continued access to, use of, participation in, or interaction with KTNA Services after changes are posted means you accept the updated Terms.
